In the event of a death all our customers are offered a home visit where we will meet with the surviving spouse and their family to read the will and discuss their various legal options.
In the event probate is necessary then the next of kin will be given free advice regarding their options. The options are the same whether we are appointed with your chosen executors, as substitute to your executors or not in the will at all.
1. They can deal with probate themselves - we will advise them of the process and let them get on with the work. They can approach us at any time for advice or reassurance.
2. They can approach a solicitor - although an option, we would not encourage this as the fees would usually amount to two or three times ours.
3. The appointed executors can ask us to deal with the legal work - we will consider the amount of work involved and then agree a fixed fee for everything, which we then confirm in writing. Our probate services are up to a third the cost of your local solicitor or bank and start from only £250 plus Vat. The majority of our work is based on a fixed fee which is agreed at the meeting and is not due until everything is complete.
For a more complex estate where we have to deal with everything, including settling the funeral bill, clearing and cleaning the house, marketing the property, dealing with the Department of Work and Pensions, the Inland Revenue, Social Services, Capital Taxes Office, attending the Probate Court and even advertising for, and settling with creditors then the fee may be a percentage of the estate - from only 2% for subscribing clients.
